1. Agreement to Terms

By accessing or using FormWit ("Service"), operated by FormWit ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Account Registration

To use the Service, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. Free Plan

FormWit offers a free plan with limited features. The free plan is available indefinitely with no obligation to upgrade. We reserve the right to modify the limits and features of the free plan at any time.

4. Paid Plans & Billing

Paid plans are billed annually. By subscribing to a paid plan, you authorize us to charge your payment method on each billing cycle.

All payments are final and non-refundable. We do not offer refunds or credits for any partial subscription periods, unused features, or dissatisfaction with the Service. No exceptions will be made to this policy.

We reserve the right to change our pricing at any time. Price changes will take effect at the start of your next billing cycle. We will notify you of any price changes in advance.

5. Cancellation

You may cancel your paid subscription at any time through your account settings. Upon cancellation:

• Your subscription will remain active until the end of the current billing period.
• You will retain access to paid features until the end of the billing period.
• No refunds or prorated credits will be issued for the remaining time in your billing period.
• After the billing period ends, your account will revert to the free plan.

6. Chargebacks & Disputes

Filing a chargeback or payment dispute with your bank or payment provider, rather than contacting us directly, will result in immediate and permanent termination of your account. All associated data may be deleted. If you have a billing concern, please contact us at support@formwit.com before initiating a dispute with your payment provider.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Send spam, phishing, or unsolicited communications.
• Collect personally identifiable information without proper consent.
• Distribute malware or engage in any activity that could harm the Service or its users.
• Exceed rate limits or attempt to abuse the Service infrastructure.
• Resell or redistribute the Service without our written consent.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service is provided "as is" and "as available." We may perform scheduled maintenance, during which the Service may be temporarily unavailable.

9. Limitation of Liability

To the maximum extent permitted by law, FormWit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described therein.

11. Intellectual Property

The Service, including its design, features, and content, is owned by FormWit and protected by intellectual property laws. You retain ownership of the data you submit through the Service.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. We are not obligated to retain your data after termination.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FormWit operates, without regard to conflict of law provisions.
